‘It is a free country’: Residents furious that man continues to take nude walks through neighborhood
COWLEY COUNTY, Kan. (KWCH/Gray News) - Residents in a neighborhood in Kansas are upset about a man they say continues to walk through their neighborhood naked.
“You’re sitting inside and you’ve got the door open, and you see this naked man walk down in front of your house,” said concerned resident Kathy McCoy.
Kathy and her son, Brody McCoy, said it’s been happening for nearly two years. They want the man to stop his naked strolls.
“You got little kids. My granddaughter is out here all the time playing,” Kathy said. “It’s disrespectful, and she shouldn’t be able to see.”
They’ve tried to confront the man, but nothing’s changed.
“He told him to get out of his yard, that it was a free country and he’ll do what he wants, that it wasn’t illegal as well,” Kathy McCoy said.
The Cowley County Sheriff’s Office confirmed that the neighborhood nudist is right; what he’s doing isn’t technically illegal.
People reached out to the sheriff about the issue and were told that because the man was not aroused in any of the instances or attempting to arouse anyone else, no law was being broken.
The sheriff’s office said the statute closest to this activity is 21-5513 Lewd and Lascivious Behavior, which requires intent on the part of the individual to arouse themselves or the sexual desires of others.
In every instance with this man, this element of the statute did not exist. However, neighbors feel that the law should change.
“You shouldn’t have to see that. If you’re a kid or an adult, you shouldn’t have to see it in your own home,” Brody McCoy said.
