Wrongful death lawsuit filed after 9-year-old Lenexa boy dies in alleged drunk driving crash
JOHNSON COUNTY, Kan. (KCTV) — The parents of 9-year-old Nolan Davidson have filed a wrongful death lawsuit against the man accused of driving under the influence and killing their son.
Ashlee and Aaron Davidson filed the suit against Matthew Jacobo in Johnson County District Court on April 19.
The civil case is filed under ‘Automobile Tort,’ meaning this case can involve wrongful death resulting from an alleged negligent operation of a vehicle.
On Dec. 1, 2023, 9-year-old Nolan Davidson and his dad were on their way to a basketball game when they were hit by an alleged drunk driver.
Nolan was rushed to the hospital and eventually put in a medically-induced coma.

25-year-old Matthew Jacobo of Kansas City, Kansas, is behind bars following that crash.
He is charged with reckless second-degree murder, DUI aggravated battery causing great bodily harm, leaving the scene of a crash, and possession of a firearm while under the influence.
The wrongful death lawsuit goes to court on May 7.
Jacobo is back in court for his criminal charges on May 29.
